This month, Canada’s Supreme Court of Canada hears oral arguments in favour of a judgmentpelling the validity of Viagra’s patent for use in treating erectile dysfunction.

The Canadian Patent Act requires the federal government to ensure that pharmaceutical companies and their authorised representatives use patented drugs to make “obvious” drugs, which the Act does not require. The Federal Court of Appeal has ruled that Pfizer’s Viagra, manufactured by Pfizer, is not an obvious invention, and that the patents of other drugs, including Lipitor, do not infringe Pfizer’s patents.

On the appeal of the Supreme Court, the court of Appeal, in ruling against Pfizer, noted that the patents of other drugs have been granted exclusivity and that the patent of Lipitor is no more infringed than any other drug.

A Pfizer patent expires in 2024, and its generic versions of Lipitor (atorvastatate) and Zocor (atorvastatin) are expected to begin to sell in 2025. Pfizer is seeking a prohibition order to prevent the generic companies from reaping the benefits of the new patents.

Pfizer has claimed that Viagra and Lipitor were the only drugs that were not obvious in this case, and that Viagra’s patent for use in treating erectile dysfunction was invalid and unenforceable.

The Federal Court of Appeal, in its decision, ruled that Pfizer’s Viagra and Lipitor are obvious and the patents of other drugs are invalid, noting that they were granted by Pfizer, not the patent of Lipitor.
